
The Supreme Court's Second Division, with Justice Park Young-jae as the presiding judge, on Wednesday upheld a lower court's ruling sentencing former Defense Intelligence Command chief Noh Sang-won to two years in prison and ordering forfeiture of 24.9 million won. Noh had been indicted on charges of violating the Personal Information Protection Act and taking bribes for mediation under the Act on the Aggravated Punishment of Specific Crimes.
Noh was indicted in June last year on charges of receiving military intelligence, including personal information of Defense Intelligence Command agents, to form the Second Investigation Unit of the Martial Law Command's Joint Investigation Headquarters. The unit was an off-the-books organization intended to investigate allegations of election fraud following the declaration of martial law.
He also faces charges of receiving a total of 20 million won in cash and 6 million won worth of department store gift certificates from former Defense Intelligence Command Central Interrogation Unit chief Colonel Kim Bong-gyu and Army 2nd Armored Brigade Commander Brigadier General Koo Sam-hoe in August and September of the previous year, in exchange for promises to help with their promotions.
