A man in his 70s who threatened a neighbor while holding a weapon, unable to contain his anger over a neighbor's dog barking loudly, has been given a suspended prison sentence.
Shin Hye-won, a senior judge in charge of Criminal Single Bench 2 at the Ulsan District Court, said on the 9th that she had sentenced A, who was put on trial on a charge of special intimidation, to one year in prison, suspended for two years. The court also ordered A to undergo probation and to perform 80 hours of community service.
A was indicted on charges of approaching B, a neighbor in his 50s, in front of his own home in Ulsan during the evening in late April this year, while holding a weapon in one hand, and threatening B with verbal abuse.
The investigation found that A, unable to momentarily contain his anger when a pet dog kept by B barked loudly, committed the offense. At the time, A shouted, "Do you raise a dog like that and keep people from sleeping and tire them out?" and yelled, "I'll kill you," threatening B as if to stab him.
The court said, "The defendant has multiple prior convictions for violence, but we took into account that he appears to have committed the offense impulsively while drunk at the time, and that he admits the offense and shows an attitude of deep remorse for his wrongdoing." It explained the reason for the sentence, adding, "We determined the sentence by comprehensively considering that the victim does not want the defendant to be punished, as well as the motive for the offense and the defendant's age."
