After raping and murdering his sister, a man in his 30s who shamelessly cared for the victim's child at the funeral home was sentenced to life imprisonment.
On the 29th, Criminal Division 1 of the Ulsan Trial Division of the Busan High Court rejected the appeal of a man A in his 30s who was handed over to trial on suspicion of violating the Special Act on the Punishment of Sexual Violence Crimes and maintained his original life sentence. They also ordered 30 years of location-tracking electronic devices and 10 years of employment restrictions in institutions related to children, adolescents, and people with disabilities.
Mr. A is accused of raping and then murdering her sister, a woman B in her 40s, in an apartment in Nam-gu, Ulsan on December 5 of last year. Since he married Mr. B's older sister in 2017, his wife has been hostile to his family due to discord with his wife and conflict with his father-in-law. Meanwhile, when her sister B did not take her side, she decided to commit a crime against Mr. B, who she was usually aiming for as a sexual target.
Mr. A showed meticulousness by preparing a neck warmer, hat, and change of clothes before the crime to hide his identity. Also, it was revealed that they searched for “woodworking fainting,” “carotid artery compression,” and “head trauma.”
On the day of the incident, Mr. A broke into Mr. B's house with a password he had secretly stolen during past family gatherings while Mr. B left the house to enroll his child. Mr. A subdued Mr. B when he returned home, then put a futon on his face and raped him.
During the crime, Mr. B knocked out the futon and shouted “brother,” and when Mr. A discovered his identity, he hit Mr. B's head against the floor and pressed his neck hard to kill him. Afterwards, he moved the body to the bathroom and sprinkled water and detergent on the floor to disguise himself as if he had died after slipping in the bathroom.
After the crime, Mr. A changed into clothes he had prepared in advance, went back to his home, naively cooked ramen, and watched pornographic material, and even visited Mr. B's funeral home to take care of the deceased's children.
Mr. A was eventually caught by the police two months after the crime. The first trial judge in this case determined that “Mr. A committed adultery and murdered Mr. B after carefully planning the tools and methods of the crime, and even after the crime, he disguised himself as an accident and destroyed evidence,” and “did not ask for forgiveness from Mr. B's survivors or make efforts to recover from the damage.”
At the same time, he sentenced Mr. A to life imprisonment, saying, “I considered the fact that there was no criminal punishment, and that the disadvantaged family environment and past experience of sexual offenses appeared to have had an impact on distorted gender perceptions.”
Mr. A appealed that “the sentence was too heavy,” but the second trial judge did not accept it and maintained the original judgment.
